Gary Gitnick, M.D.
President
Medical Board of California
1426 Howe Avenue, Suite 54
Sacramento, CA 95825-3236

Dear Dr. Gitnick and Members of the California Medical Board:

I commend you for taking the time in your upcoming meeting to consider withdrawing the appeal before the U.S. Supreme Court of the case of Medical Board of California v. Hason. Your decision to reconsider is appropriate given this case's potential for weakening the Americans with Disabilities Act (ADA).

I believe firmly that by withdrawing this case, the Board will protect patients without jeopardizing the centerpiece of protections from discrimination for disabled Americans.

As you know, the ADA is a cornerstone of our nation's civil rights protections. Since it was established in 1990, the ADA has helped thousands of Americans to become full, productive members of our community. I am confident you share my pride in California's history of leadership in disability civil rights. I am also proud of your demonstrated commitment to protecting the public from harm. And I am confident in your readiness and ability to protect patients without putting the ADA at risk.

If my Administration can provide you with any additional information in making this important decision, please let us know.

Sincerely,

GOVERNOR GRAY DAVIS
